Changing a budget mid-year: amendments and renewals

An approved budget is not a fixed object. People change jobs, staff leave, needs increase, and a plan written in February stops describing October. Amendments are the mechanism — and the timing rules catch families out.

Two kinds of amendment

Simpler

Cost-Neutral Budget Amendment

Moves money between lines without changing the total. Cannot be used to exceed the Personal Resource Account, and cannot exceed annual caps for specific services or categories.

Fuller process

Full Budget Amendment

Required where the change does not fit within the cost-neutral rules. More paperwork, and generally more review.

Families often assume anything cost-neutral is automatic. It is not — it still goes through the process, and it still has limits. Converting between certain service types has commonly required a full amendment even where the totals look unchanged.

Retroactivity: the difference between the two

This is where the two amendment types genuinely diverge, and it is worth knowing before you spend anything.

Full Amendments are not retroactive. Cost-Neutral Amendments can be.

OPWDD guidance states that Self-Direction budgets may be revised proactively to accommodate changing needs, and that Full Amendments are not made retroactively. However, a Cost Neutral Budget Amendment may be approved by the DDRO retroactive to the beginning of the month prior to the month in which it is approved.

So if the change you need is genuinely cost-neutral, there is a limited window backwards. If it is not, there is none. Either way: do not commit to a class, a rate rise or a purchase on the assumption that an amendment will reach back and cover it. Ask your broker which type yours is, and what date it was submitted.

The annual renewal

Renewal is not an amendment; it is a new budget for a new year, with recertification documentation. It is also the only moment in the cycle where you get to rethink the whole thing rather than patch it.

The renewal question worth asking out loud

"If we were starting from nothing this year, would we build this budget?" Most plans accumulate lines that made sense three years ago and have quietly survived every renewal since. Renewal is the moment to remove them, and a good broker will have a list.

Questions families actually ask

Can I move money between lines myself?

No. Even a cost-neutral change goes through an amendment and is approved by the Self-Direction Liaison. Your Fiscal Intermediary will not pay against a line that has not been approved.

How long does an amendment take?

It depends on the type and on your Regional Office's workload. A Cost Neutral Budget Amendment does not require OPWDD Central Office approval, so it has one fewer review stage than a Full Amendment. Either way, submit earlier than you think you need to.

Can an amendment increase my total budget?

A cost-neutral amendment cannot exceed the Personal Resource Account or the annual caps. If you need more than the PRA allows, that is a conversation about the assessment, through your Care Manager.

What if I have already paid for something?

Ask immediately — and ask specifically whether it can be handled as a Cost Neutral Budget Amendment, which the DDRO may approve retroactive to the beginning of the month before the month it is approved. A Full Amendment cannot be made retroactively at all. Do not assume either way, and do not spend again on that assumption.
